Gender Justice in 2026
Since 2025, the federal government has attacked LGBTQ+ rights in many ways, including challenges to transgender minors’ access to gender-affirming care, censorship of books and academic literature that references gender and sexuality, and the ability for trans girls and women to play in sports. Delaware must further distinguish itself as a leading protector of LGBTQ+ rights and ensure that all Delawareans can live authentically as themselves.

Explicitly Enshrine Marriage Equality in the State Constitution
The U.S. Supreme Court has ruled that all Americans have the right to marry who they love, free from government intervention. The landmark cases of Loving v. Virginia and Obergefell v Hodges, ensures interracial and same-sex couples could marry in every state and territory in the nation. But with the U.S. Supreme Court recently attacking past seminal decisions that affirmed liberties, advocates for marriage equality want to ensure that Delaware remains a protective state regardless of what the federal government may do.
Delaware already protects same-sex marriage equality through statute, but there is currently no law that protects interracial marriage. In 2026, lawmakers passed Senate Bill 100, which was the first leg of a constitutional amendment to enshrine both of these rights in the state constitution. By passing this amendment, lawmakers can better protect Delaware couples from future attacks from court decision, Congressional action, or attacks from the president.
